The parents of a baby who fell to the floor during childbirth are compensated with (only) 47,000 euros

On January 16, 2013, a pregnant woman went to the Virgen de la Victoria University Hospital in Malaga with symptoms of childbirth. After admission, she was transferred to the delivery room where she was attended by the gynecologist and a midwife.

During delivery, the newborn fell to the ground from a great height suffering from traumatic brain injury and bruising. The parents decided to denounce him and the Andalusian Health Service (SAS) has estimated the claim and decided to indemnify the family with 46,942 euros.

As reported by the Association 'The Patient Advocate', which has represented the girl's parents, injuries have caused maturation and school delay, need for special care, in addition to recognition of disability, not ruling out possible future neurological damage.

The association explains the facts: while the midwife exerted pressure on the belly, the gynecologist introduced some forceps to help the girl be born and when she was half of her body, "He turned, disregarding the situation, so the newborn fell from a great height."

They add in the claim that the newborn "It hit the head with surgical metal, causing the tear and tear of the umbilical cord". Therefore, they consider that:

"There was an uncoordination in the health personnel who attended the delivery, which caused the baby to fall to the ground, an issue that can not be allowed in such situations."

He suffered a hemorrhage and serious consequences

It is explained that the baby was immediately transferred to the Maternal and Child Hospital where she was diagnosed "Hemorrhage with possible cerebral edema".

The mother filed a complaint at the hospital and asked to investigate what happened. He received a letter of apology from the center.

Even so, the Patient Advocate Association has explained that parents do not rule out claiming greater amount before the courts, since they estimate that the compensation of 46,942 euros "It does not correspond to the severity of the damage."

The president of the association, Carmen Flores, adds:

"We request the opening of a sanctioning file to the gynecologist who attended the delivery and that some time is removed from her duties and that the necessary measures be taken to prevent such serious cases as this from happening again."
